880. we have no delays as we drive past the oakland coliseum. and last but not least we have a look at the san mateo bridge. you can see traffic flowing nicely. 5:00 on the nose let's head back to the desk. we are following breaking news out of livermore. we have been talking about it where a chp patrol car flipped over during a high speed chase. allie rasmus just arrived on the scene. she will join us a live report on the very latest in just a few minutes. time now 5:00. we are still on that storm watch and the bay area is still recovering from that big weekend storm that left a lot of neighborhoods reeling and picking up the pieces. that includes lafayette where a big sink -- in now that is big. a sink hole opened up on mountain view drive. this is a 20-foot sink hole. the road just collapsed after the culvert that diverts creek water under the road clogged up

with debris. cracked the sidewalk and then the road collapsed. and then making matters worse water, sewage, and gas lines are all under that collapsed road. repair crews will be working to fix it all today. then the culvert has to be replaced. reportedly a new bridge will not be built until next spring. this morning people who live in napa county are still keeping a close eye on the napa river but there is good news. the river is expected to stay below flood stage. still several feet of water are covering a peach orchard on deer park road. >> it looks like we got off pretty easy. we have some flooded vineyards and things like that. and just some washed out driveways. >> mount st. helena was one of the hardest hit areas with four inches of rain in 24 hours. 2200 people still don't have power in the greater bay area. here are some of the litest numbers from pg&e.

now the north bay and east bay have more than 600 customers still without power. south bay outages effecting 595 customers. in the santa cruz mountains 250 are still in the dark. peninsula and san francisco have no more than 50 outages each. time now 5:02. less than a month to go now. it look like congress is no closer to keeping the nation from going over. timothy indict never says the -- geithner says the ball is now in the republicans court. >> think about this. if we gave the president $1.6 trillion of new money what do you think he'd do with it? he's going to spend it. >> what we're not going to do is extend the tax cuts to the

wealthiest americans. there is no possibility that we're going to find a way to get our fiscal house in order without the tax rates going back up. >> if congress doesn't act by the end of this year, tax rates will go up for almost everybody and across the board spending cuts will take effect. that could plunge the u.s. economy into another recession. people on both sides of the controversial same sex marriage issue will be closely watching the u.s. supreme court this morning. just an hour and a half from right now the high court is due to release another list of cases. coming up at 5:15 what it will mean if california's proposition 8 is on that list and what it means if it's not. muni and other agencies are thinking about a controversial plan when it comes to their fair rates. muni is considering basing how much people pay on how much money they earn. according to the examiner some people don't think it's fair that people who are struggling to pay their bills have to pay

$64 for a monthly pass while senior citizens who have more money are only paying $22 for the same fair. now this newest plan was triggered by the debate over providing free muni passes to low income youth. 5:04 is the time. we are still talking about that accident in livermore. let's go to tara. >> this is on 580 eastbound. it happened at flin road. we had a high speed chase involving two chp patrol cars. one ended up flipping over. we saw the officer get out and walk around. now the pursuit kept going and this reached speeds of more than 100 miles an hour. so allie rasmus is live at the scene and she will let us know how it all ended. right now we will take a live look at the folden gate bridge. you can see a little mist out there this morning. very nice commute into san

patrol cars were chasing a driver when one of the officers lost control and the car the patrol car flipped over. that officer was taken to the hospital to be examined. allie rasmus is there. she's been there since 4:30. she will bring us a live update on everything. right now it's 5:07. the south bay woman was viciously attacked. how she managed to turn the tables on her attacker. more controversy surrounding comedian pat williams. we'll tell you what happened at a bar in seattle and why she is also in trouble for something that happened in the sacramento area. here's a look at 101 through san francisco. traffic flowing nicely. we will let you know if there are any problems coming up.

more problems for cat williams. he was arrested yesterday in seattle. he got into a dispute with a work earn at a bar in seattle. that arrest comes a day after williams was caught on tape slap anglo at a target store near sacramento. days before that katt williams also had a run in with police in downtown sacramento after he almost hit five pedestrians. he was also arrested recently in oakland and had a very public meltdown on stage last month.

new this morning secretary of state hillary of clinton warning there is a red line for the united states if syria uses chemical weapons from its several war. >> i'm not going to telegraph in any specifics what we would do in the event of credible evidence that the assad regime has resorted to using chemical weapons against their own people. >> secretary clinton delivered that warning to a visit to a the czech republic. this all follows intelligence reports that the syrian military has been moving chemical weapons. the victim of a purse snatching attempt fought off her attacker and chased her down the street. a man attacked the woman as she walked down homer avenue listening to head phones at about 1:00 a.m. yesterday. he pushed her down and tried to steal her purse. the woman held on even as the man punched her in the face. she kicked him he ran off.

the man got away without the purse. san francisco's board of supervisors may be close to a deal to extend the lease of a gun club for up to two years. the compromise comes after efforts to evict the gun club this summer. it could cost as much as $10.5 million to clean up soil at the site which the club has occupied for almost 80 years. time is 5:12. residents living on the peninsula still complaining about the noise from commercial jets landing at sfo. retired pilots say that probably won't change in the near future despite agreements between lawmakers and the faa. the pilots say they followed the instructions of air traffic controllers who's top priority is safety which means keeping the planes specified distances apart. the pilots are adding sfo wasn't built to handle the large amount of traffic it does have on a daily basis. a bike lane a battle is heating up in golden gate park. coming up at 5:23 why daylight

activist want to shut that bike lane down. same sex couples are eagerly awaiting news from the u.s. supreme court this morning. alison burns is in our washington, d.c. newsroom with what is at stake and when we could hear from the court. >> reporter: pam within the next few hours we expect to get word from the u.s. supreme court about more of the cases it will consider this term. the justices met friday to talk about a number of challenges to gay marriage laws. among them california's ban on same sex marriage proposition 8. supporters of same sex marriage are hoping the court will decide not to review prop 8. that would mean the lower court ruling would take hold legalizing same sex marriage in california. san francisco city officials tell us they are ready to perform marriages as soon as tomorrow. >> we will be ready with volunteers that we already have in place and volunteers who are being trained today.

at sea world in florida a dolphin bit an eight-year-old girl's hand. the girl's father was running a video caught it all on video. posted it on youtube. right there. now the dolphin bit the little girl while she was feeding it a piece of fish. she was not seriously hurt but the girl's parents say they posted that video online because they want sea world to make some changes. >> a couple things one maybe have a different way to feed the dolphins because the dolphins on a ledge that have a different type of container that is as alluring. and increase the minimum age requirement. >> while sea world released a statement. educators and animal care staff are always there on site monitoring all of their exhibits. a bike lane here at golden gate park are style -- cyclist ride between parked cars and the sidewalk along 1.5 miles of john f. kennedy drive.

the speeds of both the cars and bikes have dropped more than two miles an hour. but disability activists say it cuts off their access to the sidewalk. so now they are thinking about taking legal action to completely shut down that bike lane. the weekend storm brought major problems to the south bay and that had utility workers and law enforcement working overtime. several trees came down on to power lines and there was also major flooding at several parks. a man, woman, and child were stuck in their car because of flooding on east capital expressway in milpitas. many people now say they are stocking up on sandbags to prepare for the next storm. >> well, i was cooking and look out on the street and there was flood on the park. and it reminds us many years ago in the mid 1990s and we got flooded there. >> in mountain view a try also went down on to an apartment with one limb poking right through the roof. rain is predicted to hit the south bay tomorrow night and wednesday. our time now 5:23.

despite reports he was arrested it appears that tech mogul john mcafee is out there on the run. police in belize reportedly told the daily mail mcafee is still nowhere to be found. police called mcafee a person of interest in the murder of his neighbor. mcafee says he fears the police want to kill him. back here at home an oakland company as won the right to provide school lunches to students in 114 schools in san francisco. revolution foods won the competitive process. it's a $9 million deal that still requires school board approval. revolution foods builds itself as a healthier, fresh food alternative but costs more than other providers. students in five states will be spending more time in school. select schools in colorado, connecticut, massachusetts, new york, and tennessee they are all scheduled to announce today

altamont pass. chp officer ended up crashing his patrol car. preliminary information we have is that the officers injuries were minor. he had some head injuries one of his fellow officers took him to a nearby hospital and he is expected to recover. there is a construction site close to where the accident happened but the two far right lanes blocked off. we're not sure if that construction site may have played a role in this crash in distracting the officer. we are not sure why it started in the first place. live in livermore allie rasmus. time now 5:31. storm watch continues this

morning. no classes today at a marin county middle school because of that weekend storm. white hill middle school in fairfax suffered a lot of flooding damage in several classrooms and in their library. the principal says a lot of the campus is covered with mud. school officials haven't decided when the classes will resume. the russian river will not lean over its banks. sonoma county has opened up an operation center. it closed after the danger had passed. power outages are down to about 2200 customers from about 125,000 yesterday morning. in san francisco heavy winds and rain snapped a power pole in the sunset district. 8400 customers lost power in daly city ground saturating rain caused a 50-foot pine tree to fall on southbound 280. problem blocked two lanes and backed up traffic for an hour. drivers in lafayette dealing with another big

problem. a huge sink hole. part of mountain view drive collapsed yesterday. ktvu channel 2 reporter alex savidge is out there with what caused this mess and the work needed to fix it. good morning, alex. >> reporter: a flooded creek is what caused this huge sink hole out here in lafayette. later on crews will be back out here at the scene of this collapse here. they will be using an excavator you might be able to see. it's been brought out here so they can dig degree out of this creek and eventually hopefully secure this sink hole entirely. it will be a long slow process to build this roadway that collapsed yesterday. it could take months to do that. yesterday heavy rain overflowed the creek. and then late in the afternoon the soil eroded and the pavement just gave way. that is what created the sink hole. under ground utilities were camp mused in the collapse. a gas line had to be capped immediately. crews had to create a sewer bypass to keep waste from running into the creek.

there was a 12-inch water main that came close to rupturing but stayed intact. the problem out here the culvert that diverts water under the roadway got backed up. >> numberover logs. whole bunch of debris from upstream. came down the creek. water had nowhere to go but over the top and created an eddy. >> reporter: so now the city has to start working on a long- term fix out here at this creek. perhaps a rack of some type might be put in place so they can catch debris flowing down the creek. but a new bridge in the end likely won't be built until spring is what crews are saying. in the meantime mountain view drive here will remain shut down. meaning a lot of neighbors in this area will have to drive out of their way find an alternate route to get into downtown lafayette. live this morning in lafayette alex savidge ktvu channel 2 news. >> don't forget log on to our website ktvu.com and our mobile

apps for the very latest on weather. time is 5:34. police still searching for the criminal's blamed for friday's deadly home invasion. ktvu janine de la vega is live with more on who the police are looking for and why there are still a lot of unanswered questions. janine. >> reporter: dave, police worked all weekend and they are following up on leads. they are continuing to do that. they analyzed all the evidence to help them track down a killer. now let's go to a sketch here of the man that police are looking for. he's described as a white or latino man between 23-24 years old. he's around six feet tall and skinny with black hair and dark eyes. investigators say this man and several others broke into this multimillion dollar home when officers arrived they found the house was ransacked and the body of 66-year-old koomra his wife was beaten but did not

have any serious injuries. he is reportedly the former owner of the historic mountain winery. he also owned western cellular. so back out here live police want to make sure if you have any information about the victim or this man in the sketch who is being described as the suspect to please give police a call. reporting live janine de la vega ktvu channel 2 news. time is 5:35. later this morning the family of oscar grant goes back to court. the lawsuit that grant's family wants to move forward. new state lawmakers will take the oath of office in sacramento this morning. democrats won a historic super majority in both houses. that allowed them to -- allows them to raise taxes. but leaders say they will avoid

doing that considering voters just passed proposition 30. one of the first orders of business for the state assembly will be to honor a bay area boy scout. ryan did all the work for his eagle scout award but the boy scout says he can't have the honor because he is gay. since then he's been a guest on several national television shows where he told his story. today state lawmakers will honor him for speaking out against intolerance. 5:36. let's get everybody moving now. tara is back. there is a problem in berkeley. some sort of debris or something. the car is on the shoulder. just a heads up. let's take a live look at the bay bridge toll plaza. you can see traffic is flowing pretty well.

police on a high speed chase from san jose to oakland overnight. the chp says the driver got on to interstate 880 heading to oakland after not stopping for a traffic violation. the chase lasted several miles before the driver got off the freeway. he was finally stopped by spike strips on moraga avenue near mountain view cemetery. later this morning os -- oscar grant was shot and killed by bart police officer johan necessary mehserle on the platform of the fruitvale bart station. this morning at 9:00 if two oakland civil rights attorneys will be arguing for the ninth circuit court of appeals. arguing bart police officers should not receive legal immunity against a civil lawsuit filed by grant's family. last year a federal judge ruled to allow the lawsuit to move

ahead. the police officers appealed that ruling to the ninth circuit court. this is a seventh day of a strike at the nation's busiest port. clerical workers at the ports of los angeles and long beach set up picket lines last tuesday. they have been trying to negotiate a new contract for 2.5 years. they are also claiming their jobs are being outsourced out of the state and across the pacific ocean. now officials at the port deny that charge. the list of the dock workers are not crossing the picket lines and say the strike is costing the port as much as $1 billion every day. major development on treasure island is moving forward. they now have until the end of the month to choose a new home to make way for the development. $1.5billion project includes up to 8,000 new homes along with new commercial and office space. there have been obstacles including financing and concerns over toxic waste on

the island. developers hope to break ground by 2014. heavy rain caused major flooding at a mobile home park. that happened early yesterday morning at newels mobile city. a creek that surrounds the mobile home park overflowed causing the flooding. some of the homes in the path of the flood were damaged. >> i got my mom out. i took her down to a friends house down the street. you never know. >> heavy winds also caused damage. most of the water went down by yesterday afternoon. time now 5:46. bart officials say they are not sure yet of yesterday's big storm is to blame for two separate service problems. coming up what it was that shut down the entire system for more than an hour. 5:46 is the time right now. tara is in for sal. says it's a traffic hazard in napa. >> that is right we have a tree down. it's at meadow wood lane and it is blocking almost the entire

roadway. no word yet on when crews will be able to get that cleared away. right now we will head outside. we'll take a live look at 880. you can see the traffic is flowing nicely in both directions. and at the mccarthur maze traffic on the far right hand side of the screen folks heading to the bay bridge toll plaza. finally down on the south bay 280 at the 880 split the headlights are 280 northbound traffic as you make the drive toward santa clara. on the rain totals i would say we're doing very well wouldn't you? i mean after three days of pretty impressive totals. average for this time of year santa rosa is 7.43. 13.47 so far. 181% of normal. it's time to dry out a little bit. there is one more system especially for the north bay which could add another inch or inch and a half by wednesday. the city 7.92. average 4.81. and san jose 2.97. you can double that. not too far away. everyone is way over 100% for

rescuers call it a miracle. look at this. couple in oregon walked away after that giant tree fell on their car. right there. it's a 100-foot tree. it fell moments after the couple parked outside of a house in canby yesterday afternoon. the car was crushed. they pulled them out of the window. they were pretty shaken up but not seriously hurt. >> they must have had a bright light shining down on them. if you look at the passenger compartment especially the drivers compartment there is a space of two loafs of bread in there. >> that is incredible. now officials say the tree's roots rotted. that probably caused the tree to topple and fall. three firefighters are in the hospital after a serious accident in orinda. it happened on eastbound highway 24. it all started when an suv crashed into the center divider.

that triggered a chain reaction crash involving several other vehicles. while one of the drivers and three firefighters were standing on the right shoulder, another suv lost control and pushed another car into them. all of them were rushed to the hospital with major injuries. bart is expected to be running normally this morning. that is after two power failures disrupted service yesterday. the first problem happened just after 9:15 yesterday morning. an electrical failure halted all service. the outage also prevented bart from communicating with passengers. they were able to send updates via twitter. power was restored an hour later and then a second power outage to the same circuit hit just after 2:00 p.m.. now bart is not sure if the problem was caused by the storm. detroit's mayor is in san francisco today to make good on his world series wager with san francisco mayor ed lee. as you know the giants swept the detroit tigers in four games in october. they vowed that the leader of
